Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the QuickDecide service ("Service"), operated by Sean James ("we", "us", "our"). By creating an account, subscribing to a paid plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Our service

QuickDecide is a web-based application that allows users to create polls, share links, collect votes, and view live results. Features and availability may vary depending on whether you use the free or paid version of the Service.

3. Account and eligibility

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

4. Acceptable use

You agree not to misuse the Service. Prohibited activities include, but are not limited to: unlawful use; fraud or spam; infringement of intellectual property rights; security interference (including malware, probing, or scraping); harassment; distribution of harmful content; and any activity that violates applicable law or the rights of others.

5. Intellectual property

We retain all ownership rights in the Service, including software, documentation, branding, and other intellectual property. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with your selected plan and these Terms. You may not reverse engineer, decompile, resell, redistribute, or circumvent technical limits of the Service.

You retain ownership of the content you create using the Service. By submitting content, you grant us a limited licence solely to host and process that content for the purpose of providing the Service to you.

6. Payment and subscriptions

Paid plans are billed through our online reseller, Paddle.com. Our order process is conducted by Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

For payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms. Subscription fees are charged in advance on a monthly or annual basis depending on the plan you select. We do not guarantee uninterrupted or error-free performance of the Service.

7. Term and termination

These Terms remain in effect until terminated. We may suspend or terminate your access to the Service for: material breach of these Terms; non-payment; security or fraud risk; or repeated or serious policy violations. Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Notice after a reasonable retention period.

8. Disclaimers and liability

The Service is provided "as is" without warranties of any kind, either express or implied, to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability is capped at the total fees you paid us in the six months preceding the claim. We are not liable for indirect, consequential, or special damages, except where prohibited by law.

9. Indemnity

You agree to indemnify and hold harmless Sean James and our affiliates from any claims, damages, or expenses arising out of your content, your unlawful use of the Service, or your breach of these Terms.

10. Governing law

These Terms are governed by the laws of South Africa. Any disputes arising from these Terms or the Service shall be resolved in the courts of South Africa.

11. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
